انقضاء الشركة وتصفيتها في الفقه الإسلامي والقانون
Abstract
The study addresses the dissolution and liquidation of companies in Islamic jurisprudence and Sudanese law. The ambiguity of company provisions in Islamic jurisprudence due to different scholarly opinions is examined, along with the gap in the Sudanese Companies Law 2015. Key results: the company continues even if one partner dies if agreed upon, insolvency does not automatically dissolve a company under Islamic law, and partner withdrawal does not dissolve the company if it harms remaining partners.
